Shabana Mahmood Overhauls UK Settlement and Visa Rules

Home Secretary Shabana Mahmood has finalized a sweeping overhaul of UK immigration rules, scrapping permanent residency pathways for migrant care workers while redrawing timelines for permanent settlement.

The changes apply to migrants currently living in the UK, though anyone who already holds settled status remains unaffected. Under the revised framework, the path to indefinite leave to remain depends heavily on income bracket, visa category, and how someone entered the country.

Who It Affects

High earners pulling in more than £125,141 a year, alongside highly skilled migrants on Global Talent or Innovator Founder visas, keep a fast track to settlement, qualifying after three years. At the opposite end, migrants who have breached immigration rules or claimed certain benefits face a 20-year wait before they can apply.

For refugees, the Home Office has introduced a heavily stratified system:

  • Refugees arriving through an official government scheme hit the threshold at five years.
  • Other refugees who work or study must wait 10 years, while those who do not work or study face a 20-year wait.
  • Individuals arriving via small boats or other unauthorized routes face a 20-year wait if they work or study, stretching to 30 years if they do not.
Meanwhile, migrant care workers find their settlement route entirely scrapped under the revised proposals.

Wider Visa and Border Shifts

Beyond settlement, the March 2026 Statement of Changes brings immediate operational shifts for travelers and sponsors. Nationals of Nicaragua and St Lucia now need a visitor visa rather than an Electronic Travel Authorisation (ETA), subject to narrow transitional windows for existing bookings.

The Home Office also deleted the Transit Without Visa scheme from the Visitor Rules, forcing transiting travelers to verify their visa requirements ahead of travel. For students, entry clearance applications are now barred for nationals and citizens of Afghanistan, Cameroon, Myanmar, and Sudan.

On the employment front, Skilled Worker salary rules changed to tighten compliance checks across defined averaging windows and uneven working patterns. Asylum rules also shift, requiring further submissions to include an in-person appointment at a Service and Support Centre, while granting the Home Office explicit power to disclose asylum applications in the public interest.
